Indian tech hub state pushes jail terms for ‘fake news’, sparks worries

The growing concern in India about spreading fake news looms large. With nearly a billion internet users, the stakes are substantial in a sprawling nation with diverse ethnic and religious communities. The Delhi-based state of Karnataka has taken a bold step to combat this issue, drafting a bill titled "Misinformation And Fake News (Prohibition) Bill," which could impose hefty penalties on those narratives considered falsful.

Karnataka’s approach, though strict, aims to protect against counterfeit content. The bill defines such actions, including the promotion of superstition or the transmission of misinformation that undermines ethical values. According to a report by the Internet Freedom Foundation, content moderation initiatives are already in place, though the bill seeks to align it more closely with public conduct.

Free speech activists are uneasy about this move. Some label spreading fake news as " subjunctive crime" given its reliance on independent individuals. The freedom of expression in India is critically challenged, with widely debated tales of violence emerging in recent months. Additionally, the bill’s implications for artificial intelligence-driven videos adding to digital misinformation have strained public trust.

The bill is at the throes of controversy. Aman Taneja, a law and policy firm partner, points out that it raises regulatory responsibilities for companies, framing states like Karnataka in a≥vexing situation. Meanwhile, the bill’s introduction may reassuringly deny the existence of criminal provisions, as suggested by the Deccan Herald. This aligns with earlier attempts by Indian tech giants like Google to limit false information, but the bill could provoke an differing response from Allow trolling or defamation authorities.
