Brazil’s Supreme Court justices agree to make social media companies liable for user content

The case in Brazil concerning social media companies and illegal content has reached a significant milestone. The majority of judges in the Supreme Court of Brazil now have agreed to make social media platforms responsible for submitting illegal content by their users, marking a landmark decision for Latin America and possibly American relations.

The U.S. Secretary of State, Marco Rubio, raised concerns about this under rapids given reports of government interference in Brazilian elections, including the Jan. 8, 2023, riot where opposition to President Jair Bolsonaro targeted key institutions, including the Supreme Court in Brasilia. Rubio emphasized the potential for U.S. visa restrictions and warned that Portuguese prudent institutions, such as social media platforms, might face scrutiny. Brazil’s top legal court, the Supremo no. 2, has been pressing for a broad regulatory response.

The ruling aims to ensure free speech on social media, but the court has dissenting opinions, including André Mendonça, who dismissed the measure as unethical. Mendonça argued that the courts would not have the authority to overreach and that platforms could preemptively remove content that could undermine institutions’ credibility.

DataSource, a Brazilian thinktank, had previously criticized the proposed legislation as unnecessary, stating that social media companies should be held accountable for content they emit, including defeating its reliance on a widely regarded virtual freedom clause.
