Denver judge fines MyPillow CEO Mike Lindell’s lawyers over AI-generated fake citations: ‘This court derives no joy…’

The case before the US District Court in Denver involves a federal judge penalizing two attorneys, Kach并通过 andJennifer DeMaster, after they filed a court document using artificial intelligence (AI) that contained numerous errors. The firms were each ordered to pay $3,000 for allegedly violating court rules with the footage of their AI-generated motion failing to meet the expected standard of legal professionalism. The motion was generated independently by each firm to protest LM’s non-exhaustive emails, which contained draft versions of the document in question.

The judge, Nina Y. Wang, criticized the firms’ claims that their document was a “Crash course miracles” (a highly defective attempt at legal argumentation that fails to substantiate any claim) and awarded the penalties. She noted that the serving of the motion to the judge’s office was intercepted and that the corrected version of the legal document, which she published on file, was also flawed. Wang emphasized that AI tools sometimes produce or paraphrase content that misrepresentation of legal principles, contradicting both the parties’ and the judge’s claims. She highlighted details such as the “all-yah-qities and issues” — citations to nonexistent legal cases — which could suggest either the improper use of AI tools or gross negligence on the parties’ part. Wang interpreted the charges as mistaking the firms’ actions as accidental mistakes, especially since their emails to foster the development of the flawed document contained drafts that already contained significant errors.

The judge’s decision highlights the tension between the potential of AI tools in legal arguments and the human element of judicial oversight.

Despite the unfavorable ruling, the case leaves LCD’s defensible, albeit contrived,approach to the judge’s stance and subleases more questions about the use of AI tools in legal Proceedings and whether such tools should be placed on trial. But it emphasizes the importance of set-back mechanisms like sanctions to deter future misconduct, especially with the rise of robust, transparent, and accountable AI systems. As the case’s outcome highlights, the human elements of legal Practice continue to play a crucial role.
