Ex-Southampton County deputy sues Smithfield police, alleging ‘false i…

Jerron Richardson, a dedicated sheriff’s deputy in Southampton County, was simply trying to enjoy a regular day of shopping with his loved ones. He and his wife, Latasha, along with their three young daughters, found themselves at a Dollar General in Smithfield, a seemingly ordinary family outing. However, what began as a routine trip quickly devolved into a distressing and deeply personal ordeal that would leave an indelible mark on their lives. According to a lawsuit they’ve bravely brought forth, seeking a substantial $750,000, a simple disagreement with a cashier spiraled out of control. This wasn’t just a minor retail spat; it escalated to the point where the cashier allegedly called the police. What followed, as detailed in their complaint, was nothing short of an alleged “false imprisonment,” “gross negligence,” and the “intentional infliction of emotional distress” – serious accusations that paint a picture of a family caught in a bewildering and frightening situation. The town, in its legal response, has denied any wrongdoing, setting the stage for a contentious legal battle that will undoubtedly revisit the painful events of that day.

The immediate aftermath of the incident left the Richardson family reeling, and its long-term ramifications extended far beyond the emotional toll. While not explicitly detailed within the formal complaint, Jerron and Latasha, alongside their attorney, Derek Smith of Byler Iaquinto Law P.C., have openly shared with The Tidewater News their belief that this harrowing experience played a significant, if not direct, role in Jerron’s unexpected loss of his law enforcement position just two weeks later. Smith, a seasoned legal professional, clarified why this crucial detail isn’t present in the lawsuit itself: Southampton County isn’t a named defendant, and Virginia’s “at-will employment” laws grant employers broad discretion to terminate employees for nearly any reason, or no reason at all, as long as it’s not illegal. Despite this legal nuance, Smith is resolute in his intention to bring Jerron’s job loss to the forefront during the trial, understanding its profound connection to the incident and its devastating impact on the family’s stability and future. The date of this life-altering encounter, March 29, 2025, now stands as a stark reminder of how rapidly an ordinary day can turn extraordinary in the most unsettling ways.

The genesis of the confrontation itself, as recounted in the complaint, began with the arrival of a single police officer. Jerron, in the midst of loading his purchases into his car trunk, was abruptly confronted with a question that immediately set an unsettling tone: “Why are we getting calls about y’all?” The ambiguity and accusatory nature of the question were unsettling, especially for someone who dedicated his life to upholding the law. Jerron, attempting to defuse the situation and clarify the source of the misunderstanding, calmly directed the officer to “Sherri,” the cashier who had allegedly initiated the call. However, the officer’s response, “Well, I’m asking you ’cause I’m out here with you,” instead of addressing the core issue, seemed to indicate an immediate suspicion directed at Jerron. As Jerron himself, who is Black, confided to The Tidewater News, everything “just escalated” from that point, leading him to believe he was being “racially profiled” – a deeply painful and frustrating accusation that speaks to a broader societal issue.

As the situation intensified, Jerron, his concern growing for his family’s well-being, made a direct and reasonable plea. He informed the officer that his wife, Latasha, and their three young daughters were with him and respectfully requested that they be allowed to leave the scene. What unfolded next, according to the complaint, was a shocking escalation: the officer not only “refused to allow her to leave” but, in a chilling show of authority, “moved his police vehicle to block” the Richardson’s car “within its parking space.” This act, physically preventing their departure, solidified the feeling of being trapped and falsely imprisoned. When Jerron, understandably distressed, asked the officer to move his vehicle, the response was even more alarming. The officer allegedly declared multiple times that “no one is free to leave,” ominously adding that more officers were on their way. This call for backup brought three additional officers to the scene, transforming a family shopping trip into a tense and overwhelming police presence.

Amidst the growing tension, a glimmer of hope emerged. Jerron recognized one of the newly arrived officers, who, in turn, recognized him as a fellow member of the law enforcement community. This officer, understanding the gravity of the situation and the unnecessary escalation, “attempted to de-escalate” – a vital move to bring calm and reason back into a potentially explosive encounter. However, according to attorney Derek Smith, these crucial efforts to diffuse the situation were allegedly “thwarted” by the original officer who had responded to the scene. This suggests a deliberate refusal to let go of control or to allow a more measured approach, despite the presence of a fellow officer attempting to bring professionalism and reason to the fore. The human element here is profoundly disheartening: a chance for empathy and understanding was allegedly overridden by an unwavering stance that only served to prolong the family’s distress.

Finally, after what must have felt like an eternity, and after the officers had spoken amongst themselves, with Jerron, and notably with the cashier – who, according to the lawsuit, never once accused any member of the Richardson family of theft or assault – the family was at last given permission to leave. The resolution, though welcome, came after a period of intense fear, humiliation, and a feeling of profound injustice. The fact that no charges were ever filed against anyone, yet the family endured what they describe as false imprisonment and emotional distress, underscores the core of their legal battle. This wasn’t merely an inconvenience; it was a traumatic event that, they believe, cost Jerron his livelihood and left lasting scars on his family. Their lawsuit seeks not just financial compensation for their ordeal, but also accountability and acknowledgement of the profound impact an alleged misuse of authority had on their lives – a stark reminder that even everyday situations can unexpectedly turn into battles for justice and dignity.
