Lake Alice Family Massacre: Teen Suspect’s Defense Denies Crime Scene Tampering Allegations
A chilling tragedy unfolded in the tranquil Lake Alice community of Washington state on October 21, 2023, when five members of the Humiston family were found dead in their lakefront home. A 15-year-old family member, whose identity remains protected by a court order, was swiftly taken into custody and subsequently charged with five counts of first-degree aggravated murder and one count of first-degree attempted murder. The sole survivor of the horrific incident, an 11-year-old girl, managed to escape through her bedroom window after feigning death. She later identified her older brother as the perpetrator.
The ensuing investigation took a controversial turn when prosecutors initially accused the teen suspect’s defense team of altering the crime scene during their authorized search on October 29, 2023. The defense team had been granted a 10-hour window to photograph and 3D scan the Humiston home. Prosecutors alleged that items, including children’s backpacks, had been moved and a bottle of Clorox wipes was missing. These accusations led to the original defense attorneys withdrawing from the case. However, the prosecution later retracted their claims, admitting that overlooked photographic evidence contradicted their initial assertions.
The case has been further complicated by the appointment of a new defense attorney, Kristen Gestaut. Gestaut forcefully refuted the state’s accusations, filing a 31-page brief alleging prosecutorial misconduct. She argues that the false accusations have irreparably damaged her client’s right to a fair trial and demands a public apology from the state. The prosecution has since formally withdrawn its allegations, acknowledging the inaccuracy of their claims regarding the moved backpacks and missing Clorox wipes. This retraction followed the discovery of previously unseen photographic evidence documenting the scene.
The horrific events of October 21 began to unfold when the 15-year-old suspect placed a 911 call, claiming his 13-year-old brother had shot the family and then taken his own life. However, investigators allege that the teenager staged the scene to implicate his younger brother, Benjamin, who was found with a gunshot wound to the head and a Glock pistol in his left hand. Concurrently, a neighbor called 911 reporting the arrival of the surviving 11-year-old daughter, who had escaped with gunshot wounds and identified her 15-year-old brother as the shooter.
The surviving sister’s harrowing account, coupled with the alleged staged crime scene, has led to the teen being charged with the murders of his parents, Mark and Sarah Humiston, both 42, and his three younger siblings, Benjamin (13), Joshua (9), and Katheryn (7). He also faces an attempted murder charge for the attack on his 11-year-old sister. The teen, who has not entered a plea, is currently being held in secure detention at the Clark Child and Family Justice Center.
The case now hinges on an upcoming hearing to determine whether it will be tried in adult court. This crucial decision will significantly impact the potential penalties the teen could face if convicted. The legal battle promises to be complex, with the defense likely to focus on the initial accusations of crime scene tampering and the potential impact on the suspect’s right to a fair trial. Meanwhile, the community of Lake Alice continues to grapple with the shock and grief of this devastating tragedy. A status conference has been scheduled for January 8, 2025, as the legal process unfolds and the search for justice continues.
