RTI reforms urged to counter disinformation

The Free and Fair Election Network (FAFEN) has called for comprehensive legal reforms in Pakistan to strengthen the Right of Access to Information (RTI) Act, 2017. FAFEN believes that while Pakistan’s RTI framework is among the most progressive, its effectiveness is hampered by institutional inertia and ambiguities in the law, ineffective enforcement mechanisms, and a lack of timely information disclosure by public bodies. This push is aimed at ensuring that public bodies bear accountability and collecting government transparency, which is critical to countering disinformation and deepening political polarization in the country.

Problems with the RTI Act and FAFEN’s Implements

Under FAFEN’s policy brief, the RTI Act, formulated in 2017, has faced significant quirks and weaknesses. Its robust framework has been undermined by institutional inertia, ambiguous legal provisions, and weak enforcement mechanisms. These issues cloud the law’s ability to deliver clear, transparent, and timely information, which are essential for building trust in public institutions.

For instance, existing mechanisms for ensuring information compliance and disclosure do not meet technical and procedural standards. This results in poor compliance rates, necessitating a more robust legal framework dedicated to transparency and accountability. FAFEN emphasizes that addressing these issues is crucial to signal public bodies as effective institutions, fostering a culture of transparency and open governance.

Proosed Solutions and FAFEN’s Tenet of Accessibility

To strengthen the RTI framework and address these challenges, FAFEN proposes several key measures. First, the implementation of a comprehensive legal framework is essential for clarifying ambiguities, ensuring timely information disclosure, and digitizing records to enhance accessibility for citizens.

  • Broadening the scope of public records, ideally encouraging the public to submit existing documentation to the system, and
  • Reforming the process for the appointment and removal of information commissioners to ensure accountability.

Despite the proposed changes, FAFEN argues that effective governance without widespread buy-in requires a bipartisan parliamentary committee dedicated to facilitating consultation. This panel would facilitate input from treasury officials and discontinuation of exclusive executive control, ensuring that theểued mechanisms are widespread and represent the true interests of all stakeholders.

Another proposal is to ameliorate the existing Section 21 of the code of law by ameliorating its inelegance and broadening its reach. This would allow the PIC to function independently, ensuring that its functions align with the fundamental purpose of determining public institutions and accountability.
