This is the essence of what’s happening with the European Union’s Digital Services Act (DSA) and its Code of Conduct on Disinformation. For the first time, these digital giants – think Google, Meta, Microsoft, and TikTok, alongside a host of fact-checkers and civil society groups – have submitted reports detailing their efforts to combat the insidious spread of false information online. It’s like the first semester report card for a new, serious initiative, where everyone is showing their homework. These reports, made public through the Code’s Transparency Centre, cover a specific period, July to December 2025, and represent a crucial step in the EU’s ongoing battle against disinformation. What kind of homework are we talking about? Well, it’s about how they’re tackling misinformation around major conflicts, like the one in Ukraine, and how they’re safeguarding the integrity of our elections – two incredibly sensitive and vital areas where truth can literally change destinies.

This isn’t just another bureaucratic exercise; there’s a profound shift in how these reports are being viewed. Before, the Code of Conduct was a good-faith agreement, a handshake between the EU and these companies. Now, it’s gone from a friendly suggestion to a formal commitment, endorsed by the European Commission and the European Board for Digital Services. This elevation means the Code is no longer just a voluntary pact; it’s an integral part of the DSA’s legal and regulatory framework. From July 2025, adhering to this Code became a serious obligation, not a mere courtesy. This re-framing gives the Code a new kind of muscle. It’s like moving from a casual promise to a signed contract with penalties for non-compliance. Companies are now subject to independent annual audits to ensure they’re truly living up to their word, and the Code itself serves as a critical benchmark for proving compliance with a specific article of the DSA. For the biggest online platforms and search engines, those that have signed up, this Code isn’t just important; it’s a “significant and meaningful benchmark” for showing they’re playing by the new rules.

The depth of reporting expected varies, reflecting the different roles each signatory plays in the digital ecosystem. For the colossal players – the “very large online platforms and very large online search engines” – the expectation is high. They’re required to provide detailed reports every six months, covering the actions taken by their numerous services. Picture Google’s entire family of products: Search, YouTube, and Google Ads; then add Meta’s empire: Facebook, Instagram, Messenger, and WhatsApp; not forgetting Bing, LinkedIn, and TikTok. All these digital behemoths are under the microscope, reporting on their efforts to curb disinformation. Other signatories, like the fact-checkers and civil society groups who might not have the same sweeping influence, report annually. This tiered approach acknowledges that not all players have the same reach or the same capacity to impact the spread of information, ensuring the reporting requirements are proportionate yet comprehensive.

What’s truly groundbreaking about all this is the EU’s strategic move to weave voluntary commitments into a more robust, official oversight structure. By formally embedding the disinformation Code within the DSA framework, the EU Commission and the Board are essentially saying, “We appreciate your willingness to help, but now we’re going to give your voluntary efforts some real teeth.” It’s a clever co-regulatory dance, using those initial voluntary commitments, enhancing them with transparency reporting, and then backing them up with independent auditing. This approach aims to create a powerful defense against systemic online risks, like the pervasive spread of fake news. These initial reports, while crucial for transparency, aren’t definitive proof of compliance in themselves. Yet, their importance has been amplified significantly within the grand architecture of the DSA’s platform governance. They’re no longer just public relations exercises; they are now pieces of evidence that contribute to a larger narrative of accountability.

It’s important to remember that this first round of reports is just that – a first round. The European Commission has, for now, focused on simply making these reports public, rather than immediately dissecting their quality or judging their effectiveness. They’re stating that the reports describe the measures taken, the data collected, and the policy developments. But they’re not yet making a pronouncement on whether these actions were sufficient or truly made a dent. This distinction is absolutely critical, especially when we talk about highly sensitive areas like protecting the integrity of our elections or managing information during a global crisis. The success of these efforts isn’t just about what companies say they’re doing, but what they actually achieve. This initial transparency under the DSA is just the opening act, and the scrutiny that will follow will be intense, shaping how we all perceive the fight against disinformation in the digital age. It’s a promise of future accountability, not a pronouncement of current victory.

In essence, these first transparency reports under the DSA are a powerful signal. They show the EU’s commitment to using a multi-pronged approach – legal obligations interwoven with strengthened voluntary commitments – to rein in the wild west of online information. It’s about creating a more structured and responsible online environment for everyone. The journey ahead will involve continuous reporting, rigorous auditing, and constant review. Each step will help determine how much real-world impact this Code of Conduct will ultimately have within the larger DSA framework and how effectively it can truly help us navigate the complex and often treacherous waters of online disinformation. It’s an evolving story, and we’re all watching to see how this digital drama unfolds, hoping for a future where truth and accuracy are prioritized over deception and falsehoods.
